SUBJECT:                 ADOPTION OF AMENDMENTS TO THE EVALUATION AND APPRAISAL REPORT (EAR) OF THE CITY OF NORTH LAUDERDALE COMPREHENSIVE PLAN

 

Background:

 

The Commission adopted the City’s EAR on February 14, 2006 and designated the South Florida Regional Planning Council (SFRPC) as its review agency.  The Commission approved the transmittal of the EAR to the SFRPC for sufficiency review per Chapter 163 of the Florida Statutes.  On May 24, 2006 the SFRPC issued its final 90-day sufficiency letter.  According to this letter, there were 86 items found sufficient, 12 items that needed additional information and 2 additional comments (see Attachment A). The City Consultant, Mike Miller, has responded to these comments and he and staff have met with and spoken to staff of the SFRPC and the Florida Department of Community of Affairs to review the response (see Attachment B). All parties concurred that the information provided in the amended document is sufficient and the City may proceed to adopt the amendments to the EAR for formal consideration and approval by the outside agencies.

 

The agencies have 90 days to review the document again.  If there are no further comments, the SFRPC will issue a finding of sufficiency.  The City may then proceed to adopt the EAR-based amendments to the Comprehensive Plan. These amendments must be completed and adopted within 18 months from the time the EAR is found sufficient.

 

This item has been properly advertised according to the City’s Citizen Participation Plan included in the Comprehensive Plan.  It has been determined that further consideration by the Planning and Zoning Board is not necessary and the item may proceed to the City Commission for consideration as the adopting agency.

 

Recommendation:

 

The City Administration recommends that the Commission approve the attached Resolution adopting the amended Evaluation and Appraisal Report of the North Lauderdale Comprehensive Plan, for transmittal to the South Florida Regional Planning Council (SFRPC) for its review of sufficiency pursuant to the requirements of Chapter 163.3191 Florida Statutes.

 

 

RESOLUTION NO.  __________________

 

RESOLUTION OF THE CITY OF NORTH LAUDERDALE ADOPTING THE AMENDMENTS TO THE EVALUATION AND APPRAISAL REPORT FOR THE CITY OF NORTH LAUDERDALE COMPREHENSIVE PLAN; STATING THE INTENT OF THE COMMISSION TO AMEND THE COMPREHENSIVE PLAN BASED UPON RECOMMENDATIONS CONTAINED IN THE REPORT; AND APPROVING TRANSMITTAL OF THE REPORT TO THE SOUTH FLORIDA REGIONAL PLANNING COUNCIL, THE CITY’S DESIGNATED REVIEW AGENCY IN ACCORDANCE WITH SECTION 163.3191, FLORIDA STATUTES

 

 

WHEREAS, the Florida Legislature intends that local planning be continuous and ongoing process; and

 

WHEREAS, Section 163.3191, Florida Statures, directs local governments to periodically assess the success or failure of the adopted plan to adequately address changing conditions and state policies and rules; and

 

            WHEREAS, the City conducted a review of its current Comprehensive Plan and prepared an Evaluation and Appraisal Report; and

 

WHEREAS, the Planning and Zoning Board, acting as the designated Local Planning Agency, reviewed the Evaluation and Appraisal Report, held and advertised public hearing, provided for participation by the public in the process, and rendered its recommendations to the City Commission; and

 

WHEREAS, the City Commission adopted the Evaluation and Appraisal Report on February 14, 2006 by Resolution No. 06-02-4971 and authorized transmission to the South Florida Regional Planning Council for sufficiency review; and

 

WHEREAS, the South Florida Regional Planning Council issued a Notice of Sufficiency indicating areas that needed to be addressed; and

 

WHEREAS, a response to these issues has been prepared and attached as amendments to the EAR; and

 

WHEREAS, the City Commission has reviewed said amendments, held and advertised public hearing, and provided for comments and public participation in the process in accordance with the requirements of state law and the procedures adopted for public participation in the planning process;

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF NORTH LAUDERDALE, FLORIDA:

 

Section 1:         The City Commission does hereby adopt the amendments to the Evaluation and Appraisal Report for the North Lauderdale Comprehensive Plan, attached here as Attachment B.

 

Section 2:         The City Commission does hereby state its intention to amend the North Lauderdale Comprehensive Plan in accordance with the recommendations contained in the Evaluation and Appraisal Report.

 

Section 3:         The City Commission does hereby adopt and approve transmittal of the amended Evaluation and Appraisal Report to the South Florida Regional Planning Council, the City’s designated review agency, for the purpose of a sufficiency review in accordance with Section 163.3191, Florida Statutes.

 

Section 4:         This Resolution shall become effective immediately upon its passage.

 

Section 5:         All Resolutions and parts of Resolutions in conflict herewith are repealed.
