Background:
In an effort to limit the number of false alarms
which occur within the City of
In April 2004, the City Commission amended certain
provisions related to the alarm registration ordinance. This amended ordinance specifically changed Section
82-304 (penalty for excessive false alarms) and Section 82-321 (renewal
charges). Currently there is some inconsistency with respect to the effective
period of the alarm registrations as provided in Section 82-321(4) contained in
Ordinance No. 02-01-1045 (April 1, thru March 31) and Ordinance No. 04-04-1115(
January 1, thru December 31).
In order to remedy the inconsistency, Staff
recommends adopting the attached Ordinance to provide for an effective period
for alarm registrations from January 1 through December 31 of each calendar
year.
The City Commission approved the attached Ordinance
on first reading on March 27, 2007. It
is before the Commission tonight for second reading and final adoption.
RECOMMENDATION:
The City Administration recommends Commission’s
approval and adoption of the attached ordinance clarifying the alarm
registration period to be January 1 through December 31 of each calendar year in
Section 82-321 of the City’s Code of Ordinances.

AN ORDINANCE OF THE CITY OF
NORTH LAUDERDALE, FLORIDA, AMENDING SECTION 82-321, ENTITLED,
"REQUIREMENTS FOR ALARM USER REGISTRATION" OF THE CODE OF ORDINANCES
OF THE CITY OF NORTH LAUDERDALE, TO PROVIDE FOR CLARIFICATION WITH RESPECT TO
THE EFFECTIVE PERIOD FOR ALARM REGISTRATIONS; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN
EFFECTIVE DATE
WHEREAS, the City Commission of the City of
North Lauderdale (“City”) adopted Ordinance No. 02-01-1045 on January 8, 2002
and provided for a process for alarm registration in the City of North
Lauderdale; and
WHEREAS,
the City Commission of the City of North Lauderdale adopted Ordinance No.
04-04-1115 on April 13, 2004 in order to amend certain provisions related to
the alarm registration ordinance; and
WHEREAS,
currently there is some inconsistency with respect to the language contained in
Ordinance No. 02-01-1045 and Ordinance No. 04-04-1115 with respect to the
effective period of the alarm registrations as provided in Section 82-321(4);
and
WHEREAS,
the City Commission of the City of North Lauderdale desires to remedy the
inconsistency by adopting this Ordinance to provide for an effective period for
alarm registrations from January 1 through December 31 of each calendar year.
NOW,
THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
Section 1. The foregoing "WHEREAS" clauses are hereby
ratified and confirmed as being true and correct and are hereby made a specific
part of this Ordinance upon adoption.
Section 2. Section 82-321 entitled “Requirements for Alarm User
Registration" of the City of
Sec. 82-321. Requirements for Alarm Use r
Registration.
It shall be unlawful for any person to
install or maintain an alarm in operational order without having first obtained
an alarm installation permit and current valid alarm user registration.
(4) Alarm
registrations must be renewed each year and shall be in effect from April 1 through March 31 January 1 through December 31 of each calendar year.
Section 3. Codification. It is
the intention of the City Commission of the City of North Lauderdale that the
provisions of this Ordinance shall become and be made a part of the Code of
Ordinances of the City of North Lauderdale, Florida and that the Sections of
this Ordinance may be renumbered, re-lettered and the work
"Ordinance" may be changed to "Section",
"Article" or such other word or phrase in order to accomplish such
intention.
Section 4. Severability. If
any clause, section or other part of this Ordinance shall be held by any court
of competent jurisdiction to be unconstitutional or invalid, such
unconstitutional or invalid part shall be considered as eliminated and in no
way effecting the validity of the other provisions of this Ordinance.
Section 5. Conflicts. All
Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in
conflict herewith, be and the same are hereby repealed to the extent of such
conflict.
Section 6. Effective Date. This
Ordinance shall take effect immediately upon its adoption.
