                        Proposed Fee Schedule Revision (Appendix F) - To Modify Building Permit, Land Development and Comprehensive Planning and Zoning Fees

 

The City’s Fee Schedule that determines the amount of fees charged for various services provided by the Community Development Department has not been revised since 2002.  Due to increased costs in services, the current fees do not offset personnel-based costs incurred for providing such services. 

 

In order to off-set this cost increase for Broward County plan review/inspection services, internal personnel costs and direct costs, the Community Development Department has been reviewing the fee schedule to determine appropriate revisions. Keeping in mind the complexity of the project, the City retained the services of PMG Associates, Inc. to assist the staff.  PMG conducted the fee schedule analysis for the City in 2002 and is familiar with the City’s processes and fee structure.  PMG presented their methodology and findings to the City Commission on March 27, 2007.  In addition to the revisions proposed by PMG, the City Commission directed that language be included in the amendment that will provide assistance with certain permit fees in the event of a natural disaster.  PMG is still researching how other communities provide this service and is not ready to present a recommendation at this time.  It is requested that the Ordinance be considered on first reading tonight and that the appropriate language be considered as an amendment upon the second reading and adoption of this Ordinance or that an amendment be brought back for separate consideration and adoption, no later than June 1, 2007 -  the start of hurricane season.

 

As part of PMG’s analysis, the following Fee Schedule categories were reviewed:

 

·                    Building permit and associated fees.

·                    Land development fees (site plan, plats and public facility capacity review).

·                    Regulatory, comprehensive planning and zoning fees (land use amendments, rezoning, sign waivers, variances and special exception use permits. 

 

The basis for this analysis is an evaluation of fees charged for similar services by surrounding communities as well as actual cost incurred by the department to deliver the service.  The following process was used in reviewing these fee categories:

 

  • Review and comparison of other Cities (for this study, sixteen other Cities in Broward County were reviewed).   

 

 

  •  The actual costs incurred by providing each service. This includes obtaining the actual salary and direct expenses incurred by the City based on the respective time for specific personnel and/or outside consultants to complete any application submittal.

 

Attached is the fee analysis completed by PMG, which details their methodology and findings.

 

A summary of the proposed fee revisions are as follows:

The Chart represents an approximately 30% increase in the permit fee category.  Since building permit fees have historically been accountable for 50%-70% of total revenues for the Community Development Department, this would represent the largest increase to the overall revenues.  The Land Development and Regulatory fees historically only account for 3% to 5% of total revenues for the Community Development Department therefore these fees would not have a significant impact on the total revenues in that category.

 

Based on the study completed by PMG Associates, Inc. as outlined above, the City Administration is recommending changes to the fee schedule in the following five areas;

 

  1. Adjustment in fee schedule to reflect actual costs to provide service to the public and fall within the mid-range of surrounding municipalities
  2. Increase in minimum permit fee (from $75 to $106)
  3. Increase in development and regulatory fees such as site plan, variance, LUA to cover the actual costs, i.e. site plan fee increased from $500 to $600; rezoning from $100 to $250
  4. Recovery of direct costs-large scale development projects
  5. Incorporation of an automatic rate increase based on the Construction Price Index (CPI).  The increase could be waived or postponed by the City Commission if current conditions warrant a waiver, otherwise, if no action taken, the rate would adjust annually.

 

Upon approval of the revised fee schedule on second and final reading, the new fees will be applied to all permits issued after the effective date regardless of the date on which the application was applied for.  It is the recommendation of the City Administration that the effective date no later than Monday, June 4, 2007 be established to allow for an adequate notification period and for time to reprogram the computers with the new fee schedule.

 

The Planning and Zoning Board met on April 3, 2007, and after a presentation by the consultant, public hearing and review by the Board and Staff, adopted a motion to recommend approval of the proposed fee schedule revisions for transmittal to the City Commission with the following comments that were expressed during the meeting;

  • Concerned about impact of fee increases on individual homeowners, especially with regard to the increased cost of a variance (100%)
  • Inquired about the possibility of a “package deal” for individual homeowners who require more than one permit for construction
  • Recommended extensive notification of the upcoming increases in permit fees through means to include the City newsletter, web page and cable channel
  • Recommended extended effective date after adoption to allow for notification
  • Concerned about the impact on the proposed fee increases on the Wal-mart project
  • Discussed the comparability of cities to North Lauderdale that were used in the comparison.  Wanted to insure that outliers were discarded and that income range of residents and ability to pay was taken into account so as not to discourage them from obtaining permits or making improvements
  • Favored providing assistance with cost of permitting related to hurricane repairs but concerned about where the funding would come from
  • Supported system to allow for annual increases per CPI as opposed to larger increases on a less frequent basis

 

Recommendation:

 

If the Commission concurs with the proposed revisions to the fee schedule, as reflected in the attached ordinance, a motion is in order to approve the first reading of the attached ordinance.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, AMENDING APPENDIX F, "FEES", OF THE CITY OF NORTH LAUDERDALE CODE OF ORDINANCES BY AMENDING ARTICLE I, ENTITLED "COMMUNITY DEVELOPMENT FEE SCHEDULE", AND ARTICLE II, ENTITLED "OTHER FEES AND CHARGES"; TO PROVIDE FOR REVISIONS TO THE FEES SPECIFIED IN THE SPECIFIC SECTIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE.

 

            WHEREAS, the City Commission of the City of North Lauderdale (the "City") wishes to update Appendix F of the Code of Ordinances which govern the fees which apply to all applications, petitions and other requests for development approval including, but not limited to, general departmental, building permit, comprehensive zoning, land development, fire inspections, and other services; and

 

            WHEREAS, the City Commission of the City of North Lauderdale finds than many of the current fees do not adequately cover the cost of the time and materials used by the City's staff to review applications, zoning requests, and other matters, and should therefore be revised; and

 

WHEREAS, the City Commission of the City of North Lauderdale finds that such revisions to development fees is in the best interest of the health, safety, and welfare of the citizens and residents of the City of North Lauderdale.

 

            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, THAT:

 

            Section  1.       The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof.

 

            Section 2.        Appendix F, entitled "Fees", Article I, entitled, "Community Development Fee Schedule", and Article II, entitled, "Other Fees and Charges", of the Code of Ordinances of the City of North Lauderdale, be, and the same is hereby amended as provided in Exhibit "A" to this Ordinance, which is attached hereto and incorporated herein by reference.

 

            Section  3.       Codification.  It is the intention of the City Commission of the City of North Lauderdale that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of North Lauderdale, Florida and that the Sections of this Ordinance may be renumbered, re-lettered and the work "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention.

 

            Section  4.       Severability.   If any clause, section or other part of this Ordinance shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and in no way affecting the validity of the other provisions of this Ordinance.

 

            Section  5.       Conflicts.  All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith, be, and the same are hereby repealed to the extent of such conflict.

 

            Section  6.       Effective Date.  This Ordinance shall become effective at a later date subject to the completion of computer reprogramming per new fee schedule.

ARTICLE I. COMMUNITY DEVELOPMENT FEE SCHEDULE


Sec. 1. Generally.

(a) The fee schedules set out in this article of this appendix shall apply to all applications, petitions and other requests for development approval including, but not limited to, general departmental, building permit, comprehensive zoning, land development and other services under this section.

(b) All fees shall be paid to the city and shall be nonrefundable.

(c) Any item not covered in this fee schedule shall be charged the minimum fee, or assessed a fee based on one-half of one percent of the estimated construction cost and shall include the fees for all disciplines, the community development director may require an estimate of cost and/or other descriptive data as a basis for determining the permit fee if such fee is not presently in the fee schedule.

(d) The city, acting through its governing body, its community development or public works/utilities directors, is hereby declared to be exempt from all of the fees required by this appendix. Exemptions: After recommendation from the community development director for building and/or planning, engineering fees, the governing body may grant an exemption from the fees contained in this article, based only upon emergency, special or unusual conditions that adversely impacts the public health, safety and welfare of the city.

(e) The fee schedule shall be reviewed annually to determine if the rates warrant increases or decreases based on, but not limited to, economic conditions and costs of processing and approving development permits.

(f) The city administration shall determine the mailing, advertising costs and additional expenses reasonably incurred for the cost of processing the application and accesses the applicant for such costs prior to issuance of permit or governing body review.

(g) The fees established in this ordinance are based on 2007 costs of service.  For each year thereafter, these fees will be increased by a factor equal to the increase in the Construction Price Index.  The City Commission may, at it discretion, waive or postpone the application of any price increase.

Any item of the public record which requires more than 15 minutes of research time shall be deemed extensive. The individual making such a request shall be charged for clerical assistance for all time spent in research. The fees shall be as follows:

Sec. 3. Building permit and related fees.

(a) As provided in section 104 of the Florida Building Code (SFBC), as amended from time to time, no fee shall be charged for general maintenance or repairs which do not change the occupancy and the value of which does not exceed $1,500.00 in labor and materials as determined by the community development director.

(b) As set forth in the Florida Building Code, permits issued pursuant to these regulations shall be deemed in full force and effect until such time as the work covered thereby is complete. However, if work covered by such permit has not commenced within 180 calendar days from the date of issuance of such permit, or has been commenced and then suspended or abandoned for a period of 180 calendar days from the date of the most recent inspection, such permit shall terminate and shall become null and void. Work shall be considered to have commenced and be in active progress when, in the opinion of the city engineer or community development director, or their designees, a full complement of workers and equipment is present at the site to diligently incorporate materials and improvements into the project. When a permit has been terminated, all fees paid shall be forfeited and any work commenced after such revocation shall be subject to all the requirements and fees for a new permit as provided in this section.

(c) As set forth in section 104 of the Florida Building Code, it is unlawful for any person to fail to acquire a proper permit prior to the commencement of any construction, alteration or repair on or within private property.

(d) Any permit application for development that has a homeowners' association or management organization shall be required to submit to the community development department a notarized letter from that entity giving the applicant permission to apply.

(1) General.

a. Overtime FBC inspections. For any inspections requested to be performed before 8:00 a.m. and after 4:30 p.m., Monday through Friday, or any hour during a holiday, a special overtime fee will be charged for each inspector of each trade required for the inspection and added to the permit fee. Minimum charge per hour or fraction thereof . . . $ 50.00 $100.00

b. Special inspectors fee (board of rules and appeals) per $1,000.00 estimated construction cost for each required permit (permits, where fees are waived are not exempt from this fee) . . . 0.35

b. Training and continuing educational fees $0.01 $0.02 per $100.00 of estimated value ($0.10 $0.20 per $1,000). (3) Building certificate of occupancy and interim service facilities fee. The amounts of the certificate of occupancy fee required by section 82-4 shall be in accordance with the following schedule:

a. Residential.

1. Single-family, $150.00 per living unit.

2. Duplex, triplex and quadruplex, whether covered by a single permit or multiple permits, $150.00 base fee, plus $85.00 for each unit.

3. All other multiple dwellings having five or more living units, $450.00 base fee, plus $85.00 for each unit over five units.

b. Commercial, industrial or institutional, basic building shell. At the unit rate of $0.19 per sq. ft. applied to the total square footage of the structures under cover and/or roofed areas, whether such structures are completely and/or partially enclosed, or any part thereof; or at a rate of $190.00 for each water closet plumbing rough-in, based on actual installed rough-in and/or as indicated on the plans approved by the community development department. The highest rate shall be applicable.

c. Commercial, industrial or institutional, interior work. At the unit rate of $0.09 per sq. ft., applied to the total square footage of the structure under cover and/or roofed area, whether said structure is completely and/or partially enclosed, or any part thereof, that is applicable to the building permit issued by the community development director of the city; or at a rate of $190.00 for each extra water closet rough-in not shown and/or indicated on the plans approved by the community development department of the city. The highest rate shall be applicable.

(4) Structural.
