5601 N. State Road 7 (West intersection of SR7 and Prospect Road)      

Second reading:

Final approval to replat a portion of Tract 9 “Fort Lauderdale Truck Farms Company Plat” (approximately 27.47 acres) as recorded in Plat Book 4, at Page 31 of Public Records of Broward County, Florida to be known as “Tuscany Village Plat” and to restrict the plat to the development of not more than 400 residential units.

 

APPLICANT:             Tuscany Village

                                    (Developed by Cornerstone Group Associates, Inc.)

 

The Cornerstone Group Associates, Inc. intends to build up to 400 residential units, a combination of townhomes and condominium apartments, on the parcel of land (currently known as Imperial Estates Mobile Home Park) located at the intersection of N. State Road 7 and Prospect Road within a proposed Planned Unit Development (PUD) Zoning District. The current plat “Fort Lauderdale Truck farms” was platted prior to June 4, 1953. Per the Broward County Land Use requirements, any properties platted prior to this date needs to be replatted. The submittal by the applicant meets the sketch plat review requirements of the City and the County.

 

The Development Review Committee (DRC) met on February 15, 2006, March 22, 2006 and December 18, 2006 to review the project. Staff and Calvin Giordano & Associates, Inc., the City consultants, advised the applicant that a Traffic Concurrency Study must be completed. As a result a Comprehensive Study was conducted and the proposed use meets the traffic concurrency requirements of Broward County. The Public Works and Utilities Department and the Fire Rescue Department had no comments.  The DRC made a recommendation for approval of a final sketch plat review by the Planning and Zoning (P&Z) Board and the City Commission.

 

The Planning and Zoning Board met on January 24, 2007 and as the City Commission’s Advisory Board, unanimously recommended consideration of approval on second reading of the final plat.


 

 

RECOMMENDATION:

Staff recommends City Commission’s approval of the final plat on second reading of the attached Ordinance subject to the DRC comments, Planning and Zoning Board comments/recommendation and staff conditions listed below:

 

1.         The DRC, Planning and Zoning Board and the City Commission reserve the right to impose any additional requirements deemed necessary during subsequent approval reviews.

 

If the Commission concurs with this request, the following motion is in order:

 

“To adopt the second reading of the attached ordinance authorizing the final approval of  replat of a portion of  the east one-half (E. ˝) of the east one-half (E.1/2) of Section 12, Township 49 South, Range 41 East, according to the Plat of   “Fort Lauderdale Truck Farms” as recorded in plat book 4 at page 31 of the public records of Broward County, Florida, approximately 27.470 acres, to be known as “Tuscany Village Plat” and to restrict the plat to the development of not more than 400 residential units.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE FLORIDA, APPROVING AND ACCEPTING THE REPLAT OF LAND LOCATED IN THE CITY OF NORTH LAUDERDALE, COUNTY OF BROWARD, STATE OF FLORIDA, KNOWN AS THAT CERTAIN TRACT OF LAND DESCRIBED AS a portion of Tract 9 “Fort Lauderdale Truck Farms Company Plat” (approximately 27.47 acres) as recorded in Plat Book 4, at Page 31 of Public Records of Broward County, Florida to be known as “Tuscany Village Plat” and to restrict the plat to the development of not more than 400 residential, AS MORE FULLY DESCRIBED HEREIN, SUBJECT TO INCLUSION OF PLAT NOTE; AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF NORTH LAUDERDALE, FLORIDA TO SIGN SAID PLAT AND AFFIX THERETO THE SEAL OF THE CITY OF NORTH LAUDERDALE, FLORIDA AND TAKE OTHER ACTION; ACCEPTING THE DEDICATION OF STREETS, ROADS, ALLEYS, SWALES, BRIDGES AND OTHER PUBLIC EASEMENTS AND OTHER DEDICATIONS; CONTINGENT UPON ACCEPTANCE BY THE BROWARD COUNTY BOARD OF COMMISSIONERS, AND OTHER CONTINGENCIES AS OUTLINED IN THIS ORDINANCE; VACATING, CANCELING, VOIDING, SUPERSEDING PRIOR PLATS; PROVIDING FOR CONFLICTS; PROVIDING AN EFFECTIVE DATE.

 

            WHEREAS, the City Commission of the City of North Lauderdale ("City") has the authority to consider and approve plats within the City to provide for development of land within the City; and

 

            WHEREAS, the City Commission of the City of North Lauderdale has reviewed the Tuscany Village Plat, for the development of property located at west of SR 7 at the intersection of Prospect Road, a copy of which is attached hereto as Exhibit "A", and finds the plat to be consistent with the platting requirements as provided in State, County, and municipal law; and

 

            WHEREAS, the City Commission, through the adoption of this ordinance approves the Tuscany Village Plat, subject to the inclusion of a plat note restriction related to the number and types of residential units and provided herein; and

 

            WHEREAS, the City Commission finds that the approval of the Tuscany Village Plat is in the best interest of the health, safety, and welfare of the citizens and residents of the City of North Lauderdale.

 


            NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, THAT:

 

            Section 1.        The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof.

 

            Section 2.        That the City Commission of the City of North Lauderdale does hereby approve and accept as the Plat of Record for the purposes of issuing building permits, granting dedications and for all other purposes, that certain plat, attached hereto, and incorporated herein, to be filed for record in the Public Records of Broward County, Florida, said plat known as "Tuscany Village Plat", City of North Lauderdale, County of Broward, State of Florida, said property being described as follows:

 

A REPLAT OF A portion of Tract 9 “Fort Lauderdale Truck Farms Company Plat” as recorded in Plat Book 4, at Page 31 of Public Records of Broward County. CONTAINING 27.47 acres MORE OR LESS.

 

All said lands being more particularly described in Exhibit "A", which is attached hereto, and incorporated herein by reference.

 

            Section 3.        That the City Commission approves the plat known as "Tuscany Village Plat", subject to the inclusion of a plat note, which provides for the restriction of development within the land included on the plat to 58 townhouse units.

 

            Section 4.        That the Mayor and City Clerk of the City of North Lauderdale, Florida are hereby authorized and empowered to sign said plat and to affix thereto the seal of the City of North Lauderdale and to take such other action as may be necessary to evidence the approval of the City as herein set forth.

 

            Section 5.        That the City's approval of this Plat shall be contingent upon approval of same by the Broward County Board of Commissioners; and any and all conditions set forth by the Development Review Committee, Planning and Zoning Board and City Commission.

 

            Section 6.        That any and all previously approved and accepted Plats or portions thereof, encompassing and applicable to the property described on Exhibit "A", be and the same are hereby vacated, voided, cancelled and superseded to the extent that same are in conflict herewith and the Plat accepted and approved hereby and to the extent that the City of North Lauderdale has the power and authority to so vacate, cancel, void and supersede these previously approved and accepted plats.

 

            Section 7.        That all Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict.


 

            Section 8.        That this Ordinance shall take effect immediately upon adoption.

 

            PASSED AND ADOPTED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, ON THE FIRST READING, THIS 25 DAY OF APRIL 2006.
