i)                    Residential Solid Waste Collection Services Special Assessment

ii)                  Street Light Capital and Maintenance Special Assessment

 

As the Commission is aware, the City is contemplating levying two (2) new special assessments in October, 2008:  a residential solid waste collection services special assessment; and a street light capital and maintenance special assessment.  Because these assessments would be noticed and collected through the annual TRIM and Tax Bill method provided by Florida Statutes, the City is required to adopt an Intent Resolution for each assessment.

 

Adding these items to the 2008-2009 tax bills would shift the dollars from the Ad Valorem taxing to a special assessment, thus freeing up General Funds.

 

On the agenda tonight are the two intent resolutions prepared by our City Attorney’s office, which are required to put the County on notice that we are considering adding these items to the next year’s tax bill.  Adopting these resolutions does not commit us to anything at this time; but it does allow us additional time to research the legality of the issue and assess whether or not this would actually have positive effects on the City.

 

These items would be brought back at a future date with staff recommendations for Commission’s discussion and action.  Tonight, we are requesting Commission’s consideration and approval of both intent resolutions that will enable us to keep exploring these options.

 

RECOMMENDATION:

 

i)                    The City Administration recommendations Commission’s consideration and approval of the attached intent resolution to levy a residential special solid waste collection services special assessment to be noticed and collected through the annual TRIM and Tax Bill method provided by Florida Statutes.

 

ii)                   The City Administration recommendations Commission’s consideration and approval of the attached intent resolution to levy a special street light capital and maintenance special assessment to be noticed and collected through the annual TRIM and Tax Bill method provided by Florida Statutes.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, SETTING FORTH THE CITY'S INTENT TO USE THE UNIFORM METHOD FOR THE LEVY AND COLLECTION OF A NON-AD VALOREM SPECIAL ASSESSMENT TO BE LEVIED UPON RESIDENTIAL REAL PROPERTIES LYING WITHIN THE MUNICIPAL BOUNDARIES OF THE CITY, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED HERETO, TO FUND THE PROVISION OF SOLID WASTE COLLECTION SERVICES TO RESIDENTIAL PROPERTIES WITHIN THE CITY; STATING A NEED FOR SUCH LEVY; PROVIDING THAT A COPY OF THIS RESOLUTION SHALL BE FORWARDED TO THE PROPERTY APPRAISER, TAX COLLECTOR AND THE FLORIDA DEPARTMENT OF REVENUE; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

 

            WHEREAS, the City Commission of the City of North Lauderdale, Florida (the "City") intends to impose a special assessment to fund the provision of solid waste collection services to residential properties within the geographical boundaries of the City effective October 1, 2008; and

            WHEREAS, in accordance with Section 197.3632(3)(a), Florida Statutes, the City advertised its intent to use the Uniform Method for the collection of the assessment weekly in a newspaper of general circulation for four (4) consecutive weeks preceding the public hearing held the day hereof.  Proof of publication of such hearing being attached hereto as Exhibit "B"; and

            WHEREAS, the City Commission held a duly-advertised public hearing prior to the adoption of this Resolution; and

            WHEREAS, pursuant to Section 197.3632, Florida Statutes, as amended, the City Commission of North Lauderdale desires to set forth its intent to use the uniform method of levying and collecting a non-ad valorem special assessment to fund the cost of providing solid waste collection services to those residential properties located within the municipal boundaries of the City more particularly described in Exhibit "A," attached hereto and incorporated herein, because this method provides an economical and efficient process for such special assessments to be collected annually, commencing in October 2008; and

            WHEREAS, the City Commission of the City of North Lauderdale, Florida, directs the City Clerk to provide copies of this Resolution to the Property Appraiser, Broward County Department of Revenue Collections and the Florida Department of Revenue on or prior to March 10, 2008;

            NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, AS FOLLOWS:

 

            Section 1.        The foregoing "WHEREAS" clauses are true and correct and hereby ratified and confirmed by the City Commission.

            Section 2.        Commencing with the fiscal year beginning on October1, 2008, and with the tax statement mailed for such Fiscal Year, the City intends to use the Uniform Method authorized in Section 197.3632, Florida Statutes, as amended, for collecting the assessment to fund the costs of providing solid waste collection services to residential properties located within the municipal boundaries of City, more particularly described in Exhibit "A," attached hereto and made a part hereof.  For purposes of this resolution, “residential” means single family units and all other units receiving residential solid waste collection services.

            Section 3.                    The City hereby determines that the levy of the assessments is needed to fund the cost of solid waste collection services to residential properties within the incorporated area of the City.

            Section 4.                    Upon adoption, the City Clerk is hereby directed to send a copy of this Resolution by United States mail, certified return receipt requested, to the Florida Department of Revenue, the Broward County Department of Revenue Collection, and the Broward County Property Appraiser by March 10, 2008.

            Section 5.                    All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict.

            Section 6.                    If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.

            Section 7.                    This Resolution shall become effective immediately upon its passage and adoption.

            Section 6.                    If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.

            Section 7.                    This Resolution shall become effective immediately upon its passage and adoption.
