SUBJECT:                 SWAV 07-03B    Sign Waiver Request

 

To allow additional signage with higher letters than are allowed per section 94-16 (c) (2) c of the City’s Code of Ordinance within a Community Business (B-2) Zoning District.

 

APPLICANT:           Pollo Operations, Inc. - Pollo Tropical

8096 West McNab Road

 

Pollo Operations, Inc. on behalf of Pollo Tropical, is proposing to build a 3,438.27 square foot restaurant on an out-parcel at the Shoppes of McNab at 8096 W. McNab Road.  In conjunction with the request for site plan approval and variances, the applicant is also applying for sign waivers. The requested waiver is to permit three wall identification signs and larger letter sizes on the wall signs; two with letters 23 inches in height and the other with 18 inches in letter height.  The applicant believes that approval of this request would provide favorable exposure to their business along McNab Road and 81st Avenue.  The specific details of the request are contained in the attachments and made a part of this report.

 

Section 94-43 of the sign code makes a provision where the City recognizes that the commercial areas located adjacent to McNab Road are established business areas serving a regional population base and that certain requirements of the sign code may not be applicable.  The City Commission, therefore upon recommendation of the Planning and Zoning Board, may waive the requirements of the sign code.

 

 It is always the staff’s objective to review any application in the best interest of business viability and success.  Staff also has the responsibility to review the aesthetic and other impacts of any signage in the City. 

 

The applicant is requesting three wall signs, one at the north elevation, one at the south elevation and the other at the east elevation.  Historically, the City has permitted more than one wall sign only if the project faced two major road ways with a maximum of two wall signs being approved.  This project will face two major roadways, 81st Avenue and McNab Road. Therefore, staff recommends that the applicant be granted the sign waiver for only two wall signs based upon the following reasons:

·        There will be additional exposure on an existing monument sign at the northwest corner of the property that will be renovated to include this new business per discussions between the City and the property owner.

·        The proposed project also has numerous directional signs at various entry points to the business, thus giving it additional exposure.

·        There are two signature towers that are readily identifiable as a Pollo Tropical establishment.

·        The applicant has also requested a much larger menu board sign (39.8 sq. ft.) along McNab Road, which is more than twice the size permitted per the City’s sign Code.

·        Considering the fact that the building of the proposed business sits much closer to the roadways due to the setback variances requested by the applicant, the business is adequately visible from the main roadways.

 

As indicated earlier, in addition to the wall signs, the applicant is also requesting higher letter sizes on these signs than the 16 inches high letters permitted per section 94-16 (c) (2) (c) of the City code. 

 

The applicant has agreed that a separate monument sign for the project will not be installed.  The applicant and the property owner have agreed to work together to upgrade the existing monument sign for approval by the City.

 

On March 5, 2008 the Planning and Zoning Board met and unanimously recommended City Commission’s consideration and approval of the proposed sign waiver with all three wall signs.

 

Staff recommends that the waiver on lettering size be granted for letters no higher than 23” and that approval be granted to install only two wall signs facing the two major roadways.

 

Recommendation

 

The City Administration recommends the Commission’s consideration and approval of the attached resolution approving the sign waiver for Pollo Tropical to install and maintain no more than two wall identification signs with maximum of 23” high capital letters where only up to 16 inches high letters are allowed per Section 94-16 ( c ) ( 2 ) c of the City’s Code of Ordinance within a Community Business (B-2) Zoning District.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, APPROVING A SIGN WAIVER REQUEST FOR POLLO TROPICAL, LOCATED AT 8096 WEST McNAB ROAD, NORTH LAUDERDALE, FLORIDA, THEREBY PERMITTING THE INSTALLATION AND MAINTENANCE OF NO MORE THAN TWO WALL SIGNS WITH MAXIMUM OF 23” HIGH CAPITAL LETTERS WHERE ONLY UP TO 16 INCHES HIGH LETTERS ARE ALLOWED BY SECTION 94-16 (C) (2) c  OF THE CITY’S CODE OF ORDINANCE WITHIN A COMMUNITY BUSINESS (B-2) ZONING DISTRICT.

 

Whereas, Section 94-43, of the City's Sign Code, allows the City Commission the option to waive the requirements of the Sign Code relating to commercial areas adjacent to Rock Island Road, Southgate Boulevard, State Road 7, McNab Road and S.W. 81st Avenue; and

 

WHEREAS, Pollo Operations, Inc. located at 8096 West McNab Road, North Lauderdale, Florida, feels that the provisions of the sign code for identification sign(s) is inadequate for their needs; and

 

WHEREAS, the applicant has agreed that a separate monument sign for the project will not be permitted; and

 

WHEREAS, the City Administration recommends the approval of no more than two wall signs with maximum of 23” high capital letters; and

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA:

 

Section 1:         That the waiver of the sign code be and the same is hereby granted to Pollo Operations, Inc. to allow the installation and maintenance of no more than two wall signs with a maximum of 23” high capital letters where only up to 16 inches high letters are allowed by section 94-16 (c) 2 (c) within a community business (B-2) zoning district.

 

Section 2:         That the applicant agrees that a separate monument sign for the project will not be permitted.

 

Section 3:         That the waiver granted by this Resolution shall not excuse the applicant from compliance with each and every term, condition and provision of the City's Sign Code, the Code of Ordinances of the City of North Lauderdale, Florida, as well as the obtainment of the necessary permits.

 

Section 4:         That this Resolution shall take effect immediately upon adoption.
