                        Second Reading:

                       

                        Zoning amendment to the City of North Lauderdale Zoning Map to rezone Tract B, a total of 3.80 acres, zoned Light Industrial (M-1) to General Business (B-3).

 

APPLICANT: Nectaria Chakas, Esq.

 

The applicant is proposing to rezone Tract B a total of 3.80 gross acres of land located at 3601 W. Commercial Boulevard from Light Industrial (M-1) to General Business (B-3) only.  This Tract is part of the “The Point Plat” which contains predominantly commercial uses. The specific extent of the anticipated use is explained in Attachment A, and made a part of this report.

 

The subject property was annexed into the City of North Lauderdale on September 15, 2004. Prior to this annexation, the subject property was a part of unincorporated Broward County, where it was given its current zoning. After the annexation, the City adopted the zoning category and land use. The underlying future land use of the property is Commercial. Staff has reviewed the request for rezoning and taken into consideration the current use of the property and the compatibility of the rezoning with surrounding properties.

 

As the City Commission’s advisory body, the Planning and Zoning Board met on January 24, 2007, and after public hearing and review by the Board and Staff adopted a motion to recommend approval of the proposed rezoning to the City Commission.

 

The City Commission unanimously approved the first reading of the rezoning on January 30, 2007.  During the meeting, the applicant indicated that all of Tract A needed to be rezoned because part of it fell in the M-1 zoning category.  Staff went back and researched the zoning on both tracts and found that Tract A is already zoned General Business (B-3) and only Tract B is Light Industrial (M-1).  The information was provided to the applicant and they are now in agreement with staff’s recommendation to rezone only Tract B.  The Ordinance title advertised for second reading reflected this amendment.

 

RECOMMENDATION:

 

The City Administration recommends approval of the proposed rezoning to the City Commission. This approval is subject to the following conditions:

 

  1. All terms, conditions and provisions imposed by the City Commission, Planning and Zoning Board and staff shall be met.

 

If the Commission concurs with this recommendation, the following motion is in order:

 

“To approve the second and final reading of the attached ordinance to amend the City of North Lauderdale Zoning Map to rezone Tract B, approximately 3.80 gross acres of Light Industrial (M-1) to General  Business (B-3).”

AN ORDINANCE OF THE CITY OF NORTH LAUDERDALE, FLORIDA, REZONING CERTAIN PROPERTY LOCATED IN THE CITY OF NORTH LAUDERDALE, COUNTY OF BROWARD, STATE OF FLORIDA, TO WIT: TRACT A & B OF “THE POINT” REPLAT AS RECORDED IN PLAT BOOK 119 AT PAGE 28 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, FROM ZONING CLASSIFICATIONS GENERAL BUSINESS (B-3) AND LIGHT INDUSTRIAL (M-1) TO GENERAL BUSINESS (B-3); PROVIDING THAT THE OFFICIAL ZONING MAP OF THE C1TY OF NORTH LAUDERDALE SHALL BE AMENDED TO REFLECT SAID REZONING; PROVIDING FOR CONFLICTS: AND, PROVIDING AN EFFECTIVE DATE.

 

WHEREAS, the City Commission, after public hearing, due consideration, and being fully advised in the premises is desirous of rezoning certain property located in the City of North Lauderdale from zoning classification General Business (B-3) and Light Industrial (M-1) to General Business (B-3).

 

WHEREAS, the City Commission of the City of North Lauderdale deems said rezoning to be in the best interests of the City of North Lauderdale and the inhabitants thereof

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA:

 

Section 1:        That certain real property located in the City of North Lauderdale, Broward County, Florida, described as:

 

TRACTS A & B OF “THE POINT” REPLAT AS RECORDED IN PLAT BOOK 119 AT PAGE 28 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA. SAID TRACTS BEING MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO

 

Be and the same is hereby rezoned from the zoning classification General Business (B-3) and Light Industrial (M-1) to General Business (B-3).

 

Section 2:        That this rezoning is subject to all terms, conditions and provisions imposed by the City Commission, Planning and Zoning Board, DRC and Staff.

 

Section 3:        That the Official Zoning Map of the City of North Lauderdale as the same has been officially adopted, and is in effect at the passage hereof, be and the same is amended hereby to the extent of and in accord with the rezoning hereby granted, said amendment to be shown on said Official Map as revised.

 

 

Section 4:        That this ordinance shall take effect immediately upon final adoption.
