Subject:           Traffic-Ways Beautification & Traffic-Ways Illumination Agreements with Broward County

 

As the City Commission is aware, as part of the Neighborhood Improvement Plan (NIP) developed by Broward County prior to the annexation of Broadview Pompano Park, the County will be widening Bailey Road from State Road 7 to SW 81st Avenue.  According to the County staff, the design phase of this project is almost complete and the construction should commence in the next few months.  Upon completion, the City will be responsible for maintaining the landscaping, irrigation and lighting that will be installed by the County as part of this road widening project.

 

In order to take over the maintenance responsibilities, the City is required to enter into two separate agreements with Broward County for i) Traffic-Ways Beautification Agreement and ii) Traffic-Ways Illumination Agreement.  Attached for your review and approval are the two agreements.  The City Attorney’s Office has already reviewed and approved these documents.

 

The County will be submitting appropriate insurance certificates naming the City as an additional insured party so that the City is covered for any liability related issues during the widening of the Bailey Road project. These certificated will be made a part of these agreements prior to the start-up of the project.

 

Please be advised, at a later date, we will be entering into a separate agreement with the City of Tamarac to share this maintenance responsibility/cost as the south side of Bailey Road abuts the City of Tamarac.

 

Recommendation:

 

The City Administration recommends Commission’s consideration and approval of the attached resolution authorizing the Mayor, the City Manager and the City Attorney to enter into two maintenance agreements - the Traffic-Ways Beautification Agreement and Traffic-Ways Illumination Agreement with Broward County for Bailey Road.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, AUTHORIZING THE MAYOR, THE CITY MANAGER AND THE CITY ATTORNEY TO BE AUTHORIZED TO ENTER INTO THE TRAFFIC WAYS BEAUTIFICATION AND ILLUMINATION MAINTENANCE AGREEMENTS WITH BROWARD COUNTY FOR BAILEY ROAD.

 

BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA:

 

Section 1:        That the City Manager and City Attorney, are hereby authorized to enter into the following Bailey Road Maintenance agreements with Broward County:

i)                    Traffic-Ways Beautification Agreement

ii)                   Traffic-Ways Illumination Agreements

 

Section 2:        That this Resolution shall take effect immediately upon adoption.
