SUBJECT:     Dedication of Utility Easement to Broward County for New Fire Station 34


 

As we get closer to the completion of the new Fire Station 34 on Bailey Road, we have to enter into various agreements pertaining to water and sewer utilities with Broward County as the County still provides these services in the area. One such agreement is to grant the County an unrestricted and exclusive easement for the purpose of maintaining the water and sewer lines. 

 

As you know, the grand opening ceremony for the new Fire Station will be held on May 31, 2008. In order to hold this ceremony on the scheduled date, the City Administration/Staff had to sign off on this easement agreement on May 7, 2008 to avoid any delays. Tonight, we are requesting Commission’s approval/ratification of the attached resolution. 

 

Recommendation:

 

The City Administration recommends Commission’s consideration and approval/ratification of the attached resolution dedicating to Broward County, Florida, an unrestricted Utility Easement for the purpose of maintaining utility lines located at the Milli Romano Dyer Fire Station #34 site on Bailey Road. 

 


RESOLUTION _______________

 

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, DEDICATING TO BROWARD COUNTY, FLORIDA, AN UNRESTRICTED UTILITY EASEMENT FOR THE PURPOSE OF MAINTAINING UTILITY LINES LOCATED AT THE MILLI ROMANO DYER FIRE STATION #34 SITE LOCATED ON BAILEY ROAD; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY AND PROVIDING AN EFFECTIVE DATE.

 

            WHEREAS, Broward county is requiring the City of North Lauderdale to dedicate an unrestricted easement for the purpose of maintaining their utility lines; and

 

            WHEREAS, the City Administration recommends the dedication of the water and sewer easement and

 

            WHEREAS, The City Commission agrees to the dedication of the easement;

 

NOW THEREFORE, BE IT RESOLVED by the City Commission of the City of North Lauderdale

 

            Section 1:  Authorize the dedication of the utility easement as mentioned above;

 

            Section 2:  That this resolution shall take effect immediately upon adoption.

 

PASSED AND ADOPTED by the CITY COMMISSION of the City of North Lauderdale, Florida this 13th day of May, 2008, NUNC – PRO – TUNC, to May 7, 2008.
