RE:                 Lien Search Fee Increase

 

As indicated during the July 17, 2007 budget workshop, the time spent on the research and processing of lien searches has increased considerably since the current fee of $30.00 was put in place in 1998.  This is due to the fact that the lien searches now require more information which entails gathering information from several departments.  Therefore, the City Clerk’s Department is recommending that the lien search fee be increased from $30.00 to $40.00 for each request.

 

RECOMMENDATION:

 

The City Administration recommends Commission’s consideration and approval of the first reading of the attached Ordinance amending Article II, Section 54, Appendix F- Fees, of City’s Code of Ordinances to increase the minimum lien search fee from $30.00 to $40.00 for each request.

 

 

ORDINANCE NO. __________________

 

AN ORDINANCE OF THE CITY OF NORTH LAUDERDALE, FLORIDA, AMENDING “ARTICLE II, SECTION 54,  APPENDIX F- FEES” OF CITY’S CODE OF ORDINANCES TO PROVIDE FOR AN INCREASE TO THE MINIMUM SERVICE FEE FOR RESEARCHING AND RESPONDING TO LIEN REQUESTS;  PROVIDING FOR INCLUSION IN THE CODE; AND PROVIDING AN EFFECTIVE DATE.

 

WHEREAS, the City receives many requests for information regarding the liens placed by the City on property; and

 

WHEREAS, these requests require time expended by the City Clerk’s Department to research and reply; and

 

WHEREAS, the cost of providing this service has increased over the years; and

 

WHEREAS, the City Commission has determined that the persons originating these requests, should bear all costs associated with the service.

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA:

 

Section 1:         That  “Article II,  Section 54,  Appendix F- Fees” of  City’s Code of Ordinances be amended to provide that there shall be required a minimum service fee of forty ($40.00) dollars for researching and responding to each lien information request, said fee to be charged to the person making the request.

 

Section 2:         That this Ordinance shall take effect November 1, 2007.
