RE:                   City of North Lauderdale (“City”) / Pamela Donovan, Deputy City Clerk, and Public Information Officer Matters

 

Pursuant to the direction of the City Commission at the September 19, 2007 City Commission meeting, our office has prepared the following documents transitioning Pam Donovan from the position of Public Information Officer to that of the Deputy City Clerk /Public Information Officer (“PIO”):

 

 

 

1) A resolution reclassifying one of  the positions of Deputy City Clerk to Deputy City Clerk/PIO, providing for the inclusion of the Deputy City Clerk/PIO position in the City’s Comprehensive Pay and Classification Plan, providing for a salary range, and eliminating the PIO position.

 

2) An employment agreement for Pamela Donovan as Deputy City Clerk/PIO.

RESOLUTION

 

The resolution reclassifies one of the Deputy City Clerk positions to Deputy City Clerk/PIO and provides for the inclusion of this position in the City’s Comprehensive Pay and Classification Plan. The salary range for the Deputy City Clerk/PIO is detailed as $40,023 - $58,063. This range is consistent with what is currently offered to the City’s PIO. The resolution further incorporates the duties and responsibilities of the PIO into the position of Deputy Clerk /PIO, and expressly provides for the elimination of the PIO position.

EMPLOYMENT AGREEMENT

 

The employment agreement that we prepared is similar to the Deputy City Clerk agreements that have previously been utilized by the City. The salary detailed therein is consistent with Ms. Donovan’s current salary. The term of the agreement is for three (3) years, commencing October 10, 2007, with an option to renew upon mutual agreement of the parties.

 

The responsibilities and duties, attached to the employment agreement as Exhibit “A”, are consistent with the City’s current job description for its Public Information Officer and Deputy City Clerk, as well as those duties set forth in Section 3.15 of the City Charter.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, AMENDING THE CITY OF NORTH LAUDERDALE’S COMPREHENSIVE PAY AND CLASSIFICATION PLAN FOR THE FISCAL YEAR 2007/2008, COMMENCING ON OCTOBER 1, 2007; PROVIDING FOR A RECLASSIFICATION OF ONE OF THE DEPUTY CITY CLERK POSITIONS TO DEPUTY CITY CLERK/PUBLIC INFORMATION OFFICER; PROVIDING FOR THE INCLUSION OF THE DEPUTY CITY CLERK/PUBLIC INFORMATION OFFICER POSITION IN THE CITY’S COMPREHENSIVE PAY AND CLASSIFICATION PLAN; PROVIDING FOR A SALARY RANGE FOR THE DEPUTY CITY CLERK/PUBLIC INFOMRATION OFFICER POSITION; PROVIDING FOR THE ELIMINATION OF THE PUBLIC INFORMATION OFFICER POSITION; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; AND PROVIDING FOR AN EFFECTIVE DATE.

           

            WHEREAS, on July 17, 2007, the City Commission of the City of North Lauderdale (hereinafter referred to as the “City”) adopted Resolution No. 07-07-5243, thereby repealing the previously-adopted Resolution No. 06-07-5027, and providing for the establishment of a revised Comprehensive Pay and Classification Plan to commence on October 1, 2007; and

            WHEREAS, the City is in the process of restructuring the office of the City Clerk, and the City Commission desires to include the position of Deputy City Clerk/Public Information Officer (“PIO”) in the City’s Comprehensive Pay and Classification Plan; and

            WHEREAS, the City Commission intends for the position of Deputy City Clerk/PIO to have salary range of $40,023 - $58,063 (Grade 58); and

            WHEREAS, the City Commission further seeks to eliminate the Public Information Officer position and have the duties of the Public Information Officer incorporated into the position of the Deputy City Clerk/PIO; and

            WHEREAS, the City Commission deems the elimination of the Public Information Officer and the incorporation of the Deputy City Clerk/PIO position into the Comprehensive Pay and Classification Plan to be in the best interests of the citizens and residents of the City.

            NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, THAT:

            Section 1.        The foregoing "WHEREAS" clauses are hereby ratified and confirmed as being true and correct and are hereby made a specific part of this Resolution upon adoption hereof.

            Section 2.        The City of North Lauderdale hereby reclassifies one of the Deputy City Clerk positions to Deputy City Clerk/PIO and provides for the inclusion of the Deputy City Clerk/PIO in the City’s Comprehensive Pay and Classification Plan for the fiscal year 2007/2008. The City Commission hereby provides for a salary range for the Deputy City Clerk/PIO position of $40,023 - $58,063 (Grade 58).

Section 3.        The City Commission hereby further eliminates the position of Public Information Officer and incorporates the duties and responsibilities of the Public Information Officer into the position of the Deputy City Clerk/PIO.

            Section 4.        All resolutions or parts of resolutions in conflict herewith are hereby repealed to the extent of such conflict.

            Section 5.        If any clause, section, other part or application of this Resolution is held by any court of competent jurisdiction to be unconstitutional or invalid, in part or application, it shall not affect the validity of the remaining portions or applications of this Resolution.

            Section 6.        This Resolution shall take effect immediately upon its adoption.
