FLORIDA, AUTHORIZING THE MAYOR OF THE CITY OF NORTH LAUDERDALE, FLORIDA, ON
BEHALF OF THE CITY, TO EXECUTE AND TO OTHERWISE ENTER INTO THE ATTACHED
EMPLOYMENT AGREEMENT BETWEEN THE CITY OF NORTH LAUDERDALE AND PAMELA DONOVAN,
DEPUTY CITY CLERK/PIO; AUTHORIZING THE MAYOR TO DO ALL THINGS NECESSARY TO
CARRY OUT THE AIMS OF THIS RESOLUTION, AND, PROVIDING FOR AN EFFECTIVE DATE.

EMPLOYMENT
AGREEMENT
THIS IS AN AGREEMENT made and entered into this _______ day of ____________________, 2007 between the CITY OF NORTH LAUDERDALE, a Florida Municipal Corporation, hereinafter referred to as “CITY” and PAMELA DONOVAN, hereinafter referred to as “DEPUTY CITY CLERK/PUBLIC INFORMATION OFFICER (“PIO”)”.
IN CONSIDERATION
of the promises, the mutual covenants, conditions, provisions and undertakings
herein contained, and for other good and valuable considerations, the parties
do mutually covenant and agree with each other as follows:
ARTICLE I
TERMS AND CONDITIONS -- THE CITY
1.0 The CITY agrees as follows:
1.1
To employ
PAMELA DONOVAN as the DEPUTY CITY CLERK/PIO for a term hereinafter referred,
consistent with the terms, conditions and covenants of the Charter of the City
of
1.2 To pay and to compensate the DEPUTY CITY CLERK/PIO the sum of FORTY-EIGHT THOUSAND NINE HUNDRED SEVENTY-TWO DOLLARS AND 00/100 ($48,972.00), for the first year of this Agreement (October 10, 2007 to September 30, 2008) in accordance with the regularly scheduled method of compensation for other municipal employees. The City Commission shall undertake to review the DEPUTY CITY CLERK /PIO's performance no less than annually based on administrative review criteria established by the City Commission for other contractual employees of the City.
1.3 The CITY further agrees to pay the DEPUTY CITY CLERK/PIO an annual salary adjustment beginning October 1, 2008 equal to the amount approved by the City Commission in the annual Comprehensive Pay Plan in the same manner and amount as any salary adjustment given to other City Employees. If City Employees do not receive a salary adjustment, the DEPUTY CITY CLERK/PIO shall not receive a salary adjustment.
1.4 CITY agrees to provide the DEPUTY CITY CLERK/PIO with the same insurance benefits, educational enrichment benefits, holidays, sickness and other leave benefits, accrual of and taking of vacation benefits, disability benefits and pension plan benefits, as established by the City’s Personnel Policies and Regulations. In the event this Employment Agreement is terminated, insurance benefits shall continue to be offered to the DEPUTY CITY CLERK/PIO in conformance with all applicable Federal, State, and local laws.
ARTICLE
I
TERMS AND CONDITIONS — DEPUTY CITY CLERK/PIO
2.0 The DEPUTY CITY CLERK/PIO agrees as follows:
2.1 To continue employment by the CITY in the capacity of DEPUTY CITY CLERK/PIO of the City of North Lauderdale, Florida, subject to the direction, supervision and orders and the overall responsibility to the legislative, administrative and statutory duties of the City Commission.
2.2 DEPUTY CITY CLERK/PIO shall fulfill the obligations and responsibilities that are customarily attributed to the position and title of DEPUTY CITY CLERK/PIO generally in South Florida, shall perform all of the duties, work services and functions as set forth in Section 3.15 of the City of North Lauderdale Charter as well as the City of North Lauderdale description for the position of DEPUTY CITY CLERK/PIO, a copy of said job description being attached hereto as Exhibit “A” and incorporated by reference herein as specifically as if set forth at length herein. The DEPUTY CITY CLERK/PIO warrants that she possesses the requisite skills and background to perform as required hereunder.
2.3
The DEPUTY CITY CLERK/PIO further represents that she
meets or exceeds all of the minimum qualifications and requirements that are
required by the said position description, attached, by the laws of the State
of
2.4 That the position of DEPUTY CITY CLERK/PIO is not and can not be an hourly-type employment. Hence, the DEPUTY CITY CLERK/PIO shall do all things necessary and required to be available to the CITY to attend various meetings of the City Commission and its various advisory and charter-established boards in addition to all other administrative and employment requirements, as requested.
ARTICLE II
TERM AND TERMINATION
3.0 This Agreement shall commence on October 10, 2007 and shall terminate on September 30, 2010. However, the parties hereto further agree that this Agreement may be renewed for an additional three (3) year period, at its natural termination, or as agreed to by the parties in a latter document of equal dignity herewith.
3.1 In the event the DEPUTY CITY CLERK/PIO elects to voluntarily terminate this Employment Agreement prior to the expiration date, she shall provide the CITY with not less than forty-five (45) days written notice to the City Commission of the CITY indicating her intention to discontinue employment as the DEPUTY CITY CLERK/PIO.
3.2 In the event the CITY elects to terminate this Employment Agreement for any and no reason prior to the expiration hereof, the CITY shall comply with the terms, conditions and provisions contained in the Charter of the City of North Lauderdale, and CITY shall provide no less than 45 days written notice to the DEPUTY CITY CLERK/PIO indicating the CITY'S intention to terminate the DEPUTY CITY CLERK/PIO's employment with the CITY.
3.3 If the CITY elects to terminate this agreement for any reason, the CITY shall provide the DEPUTY CITY CLERK/PIO with a payment equivalent to the DEPUTY CITY CLERK/PIO's salary for a period of sixty (60) calendar days from the date the CITY provides the DEPUTY CITY CLERK/PIO written notice of its intent to terminate this Employment Agreement.
3.4
In addition to the above, the parties may terminate
this Agreement at any time and on any agreed basis by mutual consent of both
parties provided same is reduced to writing and filed amongst the public
records of the City of
ARTICLE IV
NOTICE
When any of the parties desire to give notice to the other,
such notice must be in writing, sent by U.S. Mail, postage prepaid, addressed
to the party for whom it is intended at the place last specified; the place for
giving notice shall remain such until it is changed by written notice in
compliance with the provisions of the paragraph. For the present, the parties designate the
following as the respective places for giving notice:

MISCELLANEOUS
5.0 It is understood and agreed that this document incorporates and includes all prior negotiations, correspondence, conversations, agreements or understandings applicable to the matters contained herein and that the parties agree that there are no commitments, agreements, or understandings concerning the subject matter of this Agreement that are not contained in this document. Accordingly, it is agreed that no deviation from the terms hereof shall be predicated upon any prior representatives or agreements whether oral or written.
5.1
It is
further agreed that no modification, amendment or alteration in the terms of
conditions contained herein shall be effective unless contained in a written
document executed with the same formality and with equal dignity herewith.
5.2 Counterparts: This document shall be executed in at least three (3) counterparts each of whom shall be deemed to be a duplicate original.
5.3
5.4 Litigation: In connection with any litigation arising out of this Agreement, including any administrative, trial level or appellate proceedings, the prevailing party shall be entitled to recover all costs incurred, including a reasonable attorneys fee.
5.5 Severability/Integration: If any clause, section or other part or application of this Agreement shall be held by any court of competent jurisdiction to be unconstitutional or invalid,

such unconstitutional or invalid part or application shall be considered as eliminated and so not affecting the validity of the remaining portions or applications remaining in full force and effect.

DEPUTY CITY CLERK I/PIO
|
This is a contract position, appointed by the City Clerk and followed by a contract approval by the City Commission.
This is a combination of clerical and Public Information work in the
Office of the City Clerk. An employee in
this class serves as the assistant to the City Clerk. The duties include assisting in the day to
day operations of the City Clerk’s department. In addition, the position
requires performing professional journalistic and public relations work of
considerable responsibility.
The scope and responsibilities of this employee are set forth in the
City of
Acts as assistant to City Clerk.
Maintains department or division files, cross-references information.
Scans official documents and records.
Assists in planning work involved in maintaining official City
documents and records.
Performs lien searches on real estate within the City, answering
requests from title companies.
Assists in formulating records and minutes of City Boards and
Committees.
Copies, faxes and distributes documents and mail at the request of the
City Clerk and City Commission.
Responsible for research, design, preparation and distribution of
City’s public publications, bulletins, brochures, special reports, forms, posters, report
covers, logos, new resident welcome packets and Commission meeting
presentations; videos and other materials
designed to expand and improve external communications;
Fosters and maintains strong City
relationships with local media (press, news media, and cable company). Prepare news stories and
public policy statements; coordinate
with the City Commission regarding interviews and responses from City
officials, answers inquiries from media and general public regarding City
current issues, while maintaining an effective crisis communications plan;
Prepares news releases, quarterly resident newsletters, assists in
planning special event ceremonies for elected officials, attends and prepares
presentations at group and homeowner meetings communicating City’s efforts and
public services, prepares, conducts and reports on citizen surveys and develops
a comprehensive City public information program.
Prepares and maintains City’s Web Page public information content, cable T.V. channel content, and electronic roadway marquee sign content. Serves as communications liaison with local civic associations, non-profit organizations and citizens regarding public information matters.
Initiate photos, writes program-related articles, drafts and tapes radio scripts and public service announcements; develops and maintains a library of feature stories, fact sheets, photographs and transparencies suitable for distribution.
Performs any additional duties as requested by the City Clerk.
Thorough knowledge of the principles and practices of office procedures
and business English and spelling. Ability to plan, compose, edit and
graphically produce public information materials and reports.
Clerical aptitude and working knowledge of pertinent laws and
procedures.
Ability to use good judgment in making decisions in conformance with
laws, regulations, and policies.
Ability to meet the public, to understand their questions, and to
provide clear answers.
Ability to keep complex records and accurate reports.
Ability to establish and maintain effective working relationships with departmental officials, other municipal employees, professional groups, and the general public.
Skilled in applying attention to detail in preparing reports, correspondence, press releases, articles and public service announcements.
Capability to work under stressful conditions, and make independent judgments in non-routine and unstable situations (able to effectively handle unforeseen situations thoughtfully and effectively in an extemporaneous fashion).
Must be knowledgeable in administrative, public information principles and practices of municipal government agencies. Must maintain a high degree of confidentiality commensurate with duties and responsibilities of the City Clerk department.
Possess substantial direct experience in the field of public
information, communications, and marketing.
Helpful if this is coupled with experience in public administration of a
government agency or related field.
Prefer bachelor’s degree from a SACS-accredited school in Journalism
Communications, or related field. Prefer
three years experience in public relations / public information,
communications, advertising, marketing, or news writing / reporting.
Considerable experience performing difficult clerical and stenographic
work, including or supplemented by courses in secretarial/administrative
procedures or any equivalent combination of experience and training.
Graduation
from a standard high school is required.
Computer literate. Must be highly proficient in the use of
computer software including Microsoft
Office Suite (PowerPoint, Excel, Word and Outlook). Able to prepare Public Information materials via
use of standard computer software applications including layout, graphic
design, digital photos, etc. Ability to
use digital scanning systems, and maintain City’s web-site public information.
Considerable experience in the performance of responsible and difficult
clerical work including the assembly, promulgating, recording, and keeping of
official files and records. Ability to
type 35 words per minute.
Must be physically able to operate office and communication equipment,
possess visual, auditory, and oral acuity; the ability to lift/carry up to 30
pounds. The position requires periods of
sitting, standing, bending, stooping, and walking.
