SUBJECT:     Water Splash Area Installer

 

As you know, the City is in the process of installing a Water Splash Play area at the Aquatic Center, which will be open to public along with the re-opening of the pool on March 1, 2007. This project is being funded through the Florida Recreation Development Assistance Program (FRDAP) grant of $400k - $200k in state grant & $200k City match). The final major step of completing this project is to select a vendor to install various components of the structure.  The City has selected 3 vendors to provide the splash equipment and filtration system (items on consent at tonight’s agenda).  The vendors selected provided the best prices through the RFQ process offered by the Project Engineer. 

 

Installation of the play area is a rather detailed process that requires a professional installer to handle different components and systems of the water feature.  The installer will be required to provide the following services:

 

·        Removal of a portion of the existing pool deck

·        All associated electrical work

·        Laying of PVC water pipes, system valves, and sensors

·        Coordination of sensors to provide true effects of water components

·        Installation of water splash features

·        Installation of water filtration/circulation system

·        Installation of new concrete

·        Installation of spray deck material

 

The installer, like Engineer, needs to be aware of the numerous codes by the various jurisdictions (County Health Department, County Building, Electrical, Plumbing and Structural) that will review and inspect the installation of the play area.

 

After discussing the requirements of the installer with the City approved Project Engineer, Aquatic Technologies, the City contacted Ultimate Pools to provide a detailed quote for this project.  Ultimate Pools is a local vendor, located in Davie, Florida.  Ultimate Pools is one of, if not the best pool renovation company in the area.  Ultimate Pools has completed numerous projects for the City at the Aquatic Center as well as the Senior Center Pool and their work has always met or exceeded our expectations.  Along with having worked closely with the City in the past, Ultimate Pools has also worked closely with the Project Engineer Aquatic Technologies and is extremely familiar with the splash area components and filtration system we are purchasing.

 

Ultimate’s quote for this project is $148,500.00 and funding is available in the FDRAP grant project budget.  Under Ultimate Pool’s proposal, they will be responsible for all phases of the installation as outlined above. The original estimate in the grant application for this part of the project was only $100,000. However, this estimate was based on the numbers determined 4 years ago when the grant application was submitted. The new quote provided by the vendor will force the project to be slightly over the project budget by approximately $30,000.00. 

 

While the department made every effort to develop and submit a complete and accurate Grant Application, we regret the fact the project will be slightly over budget.  In order to make up for this overage, with the approval of the Commission tonight to proceed with the contracting of Ultimate Pools, staff will use some of the $150,000 originally allocated in 2005 for some Hurricane Wilma related west end renovations of the Hamptons Pines Park.  As a result of a $500,000 grant the City received recently from Broward County for the Hamptons Pines renovations, the funding originally allocated is now available and can be used to offset the additional $30,000 needed to install the water splash play area. The balance of this allocation for the Hampton Pines Park project ($120,000) will be returned to the Department’s Capital Fund Reserve.    

 

Section 9.10 (C) of the City Charter authorizes purchases in excess of $10,000 without bids or quotes, it further states “……..All of the requirements of this section shall be deemed waived if it shall be determined by the City Manager or City Council that there is a situation, occurrence or exigency necessitating immediate or quick action not permitting adequate time to utilize competitive bidding conditions. The circumstances justifying the waiver of the provisions of this section need not be wholly unforeseen, sudden or unexpected. Circumstances being deemed justification for a waiver of the provisions of this section shall be, in the case of a City Manager's determination, reduced to writing and filed with the City Clerk, with copies to the Council; and in the case of the City Council's determination shall be specifically set forth in the minutes of the meeting at which said determination is made.”

 

Under the conditions set forth in Section 9.10 (C ) of the City Charter, we are requesting the authorization to proceed with Ultimate Pools for the Aquatic Center Water Splash Area Renovation due to the following justifications:

 

·        Has committed to have the project completed by the Aquatic Center’s planned re-opening date of March 1, 2008

 

·        Has an excellent working relationship with the project engineer, Aquatic Technologies and the City staff.

 

·        Has handled for the City the overwhelming and complex renovation projects at the Aquatic Center and Senior Pool in the past.

 

·        Has installed numerous play splash play areas throughout Florida and has built swimming pools and facilities internationally.

 

·        In the opinion of Staff and our Engineer, Ultimate Pools is one of the best, if not the best pool construction contractors in the area.

 

·        Has completed all previous City Projects on time and within the quoted proposal.

 

·        Is familiar with the Project Components.

 

·        Excellent relationship with the Broward County Health Department who has to approve project plans and construction.

 

It is staff’s opinion that the eight (8) conditions outlined above provide adequate justification for the awarding of the contract to Ultimate Pools for the installation of the water splash area and all other related components.

 

Recommendation:

 

The City Administration recommends Commission’s consideration and approval of the attached resolution authorizing the awarding of a contract to Ultimate Pools in an amount not to exceed $148,500.00 for the installation of the water splash play area at the Jerry Resnick Aquatic Center.

 


 

RESOLUTION NO. ______________

 

A RESOLUTION OF THE CITY OF NORTH LAUDERDALE AUTHORIZING THE AWARDING OF A CONTRACT TO ULTIMATE POOLS IN AN AMOUNT NOT TO EXCEED $148,500.00 FOR THE INSTALLATION OF THE WATER SPLASH PLAY AREA AT THE JERRY RESNICK AQUATIC CENTER, AND PROVIDING FOR AN EFFECTIVE DATE.

 

WHEREAS, the City Commission of the City of North Lauderdale, Florida has authorized the purchase of various components for a Water Splash Area; and

 

WHEREAS, the City intends to utilize both City and State FRDAP funds for this project; and

 

WHEREAS, the City Commission and City Manager determine that the cost quoted from Ultimate Pools is in the best interest of the City, and that justification exists as outlined in the agenda item memorandum under section 9.10 (C ) of the City Charter to proceed; and

 

WHEREAS, the City of North Lauderdale has available Capital Funds for this project in the Parks and Recreation Department Capital Budget.

 

WHEREAS, the City shall pay Ultimate Pools an amount not to exceed $148,500.00.

 

WHEREAS, the City shall utilize capital funds from the Parks and Recreation Department’s budget to offset project overages; and

 

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, THAT:

 

Section 1.         This Resolution shall become effective immediately upon its passage and adoption.
