First reading Preliminary and Final approval to replat a portion of NW ¼ of section 18
(approximately 3.8961 acres) as recorded in Plat Book 312B, at Page 352 of
Public Records of Broward County, Florida to be known as “Temple Messianique
Plat” restricted to 63,000 square feet of Charter School, 10,000 square feet of
Pre-Kindergarten use and 160,000 square feet of commercial use.
APPLICANT: Global
Ministries of Florida, LLC
The applicant came before the
City Commission on June 30, 2009 requesting approval to subdivide the subject
property in order to build a charter school
and a commercial retail building. The subdivision was as follows; Parcel A
(1.7819) acres to be restricted to 53,000 square feet of community facility
use, specifically public school, and Parcel B (2.1142) acres restricted to
160,000 square feet of commercial use. When the application was submitted to Broward
County for approval, the County made a few corrections which increased the
square footage and changed the use.
The
applicant is back before you tonight with a revised request, which subdivides
as follows; Parcel A (1.7819) acres to be restricted to 63,000 square feet Charter
School, 10,000 square feet of Pre-Kindergarten and Parcel B (2.1142) acres restricted to
160,000 square feet of commercial use. The
subject area is located on State Road 7 and
The proposed plat, to be known as “Temple
Messianique Plat”, will be restricted to 233,000 square feet of development.
The Development Review Committee (DRC) first met on January 14, 2009 and again on February 3, 2010. Comments were provided, and the applicant responded to the comments on the project. Staff and Calvin Giordano & Associates, Inc., the City consultants, felt that all the conditions were met and recommended to forward the plat to the Planning and Zoning Board for consideration and approval.
The Planning and Zoning Board met on February 17,
2010, as the City Commission’s Advisory Board, and unanimously recommended
consideration of approval on first reading of the proposed plat.
Recommendation:
The City Administration recommends City Commission’s approval of the proposed plat on first reading of the attached Ordinance subject to the DRC comments, Planning and Zoning Board comments/recommendation and staff conditions listed below:
1.
This plat
shall be approved by the Broward County Development Review Committee prior to
the final approval of the second reading by the City Commission.
2.
The DRC, Planning and Zoning Board and the City
Commission reserve the right to impose any additional requirements deemed
necessary during subsequent approval reviews.
If the Commission concurs with this request, the following motion is in order:

accepting the proposed plat and subdivision
of a tract of land in the Northwest one-quarter (NW ¼) of section 18, township
49 South, range 42 East as recorded in Book 3128 at Page 352 of the public
records of Broward County, Florida, approximately 3.8961 acres, to be known as “Temple Messianique Plat” and to restrict the plat to the development
of 63,000 square feet of Charter School, 10,000 square feet of Pre-Kindergarten(Parcel
A) and 160,000 square feet commercial use (Parcel B).

ORDINANCE OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE FLORIDA,
APPROVING AND ACCEPTING THE PLATTING AND SUBDIVISION OF LAND LOCATED IN THE
CITY OF NORTH LAUDERDALE, COUNTY OF BROWARD, STATE OF FLORIDA, KNOWN AS THAT
CERTAIN TRACT OF LAND IN THE NORTHWEST ONE-QUARTER (NW ¼) OF SECTION 18,
TOWNSHIP 49 SOUTH, RANGE 42 EAST (approximately 3.8961 acres) as recorded in
Book 3128, at Page 352 of Public Records of Broward County, Florida to be known
as “TEMPLE MESSIANIQUE PLAT” and to restrict the plat to the development of
63,000 SQUARE FEET OF CHARTER SCHOOL, 10,000 SQUARE FEET OF PRE-KINDERGARTEN
(PARCEL a) AND 160,000 SQUARE FEET OF COMMERCIAL USE (PARCEL b), AS MORE FULLY DESCRIBED HEREIN, SUBJECT TO INCLUSION OF PLAT NOTE;
AUTHORIZING THE MAYOR AND CITY CLERK OF THE CITY OF NORTH LAUDERDALE, FLORIDA
TO SIGN SAID PLAT AND AFFIX THERETO THE SEAL OF THE CITY OF NORTH LAUDERDALE,
FLORIDA AND TAKE OTHER ACTION; ACCEPTING THE DEDICATION OF STREETS, ROADS,
ALLEYS, SWALES, BRIDGES AND OTHER PUBLIC EASEMENTS AND OTHER DEDICATIONS;
CONTINGENT UPON ACCEPTANCE BY THE BROWARD COUNTY BOARD OF COMMISSIONERS, AND
OTHER CONTINGENCIES AS OUTLINED IN THIS ORDINANCE; VACATING, CANCELING,
VOIDING, SUPERSEDING PRIOR PLATS; PROVIDING FOR CONFLICTS; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City Commission of the City of North Lauderdale
("City") has the authority to consider and approve plats within the
City to provide for development of land within the City; and
WHEREAS, the City Commission of the City of North
Lauderdale has reviewed the Temple Messianique Plat, for the development of property located at
Southside of Prospect Road and East of State Road 7, a copy of which is
attached hereto as Exhibit "A", and finds the plat to be consistent
with the platting requirements as provided in State, County, and municipal law;
and
WHEREAS, the City Commission, through the adoption of this ordinance approves
the Temple Messianique Plat, subject
to the inclusion of a plat note restriction related to the types of use and provided herein; and
WHEREAS, the City Commission finds that the approval of the Temple Messianique Plat is in the best interest of the health, safety,
and welfare of the citizens and residents of the City of North Lauderdale.
NOW,
THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF NORTH LAUDERDALE, FLORIDA, THAT:
Section
1. The foregoing "WHEREAS"
clauses are hereby ratified and confirmed as being true and correct and are
hereby made a specific part of this Ordinance upon adoption hereof.
Section 2. That the City Commission of the City of North Lauderdale does hereby
approve and accept as the Plat of Record for the purposes of issuing building
permits, granting dedications and for all other purposes, that certain plat,
attached hereto, and incorporated herein, to be filed for record in the Public
Records of Broward County, Florida, said plat known as "Temple
Messianique Plat",
City of North Lauderdale, County of Broward, State of Florida, said property
being described as follows:

PLAT AND SUBDIVISION of a tract of land in the Northwest one-quarter (NW ¼) of
section 18, township 49 South, range 42 East as recorded in Book 3128 at Page
352 of the public records of Broward County, Florida, approximately
3.8961 acres, to be known as “Temple
Messianique Plat” and to restrict
the plat to the development of 63,000 square feet of Charter School,
10,000 square feet of Pre-Kindergarten (Parcel A) and 160,000 square feet
commercial use (Parcel B).
All said lands being more particularly described in Exhibit "A", which is attached hereto, and incorporated herein by reference.
Section 3. That the City Commission approves the
plat known as "Temple Messianique Plat", subject to the
inclusion of a plat note, which provides for the restriction of development
within the land included on the plat to 63,000
square feet of Charter School, 10,000 square feet of Pre-Kindergarten use
(parcel A), and 160,000 square feet of Commercial Retail use.
Section 4. That
the Mayor and City Clerk of the City of North Lauderdale, Florida are hereby
authorized and empowered to sign said plat and to affix thereto the seal of the
City of
Section 5. That the City's approval of this Plat shall be contingent upon approval
of same by the Broward County Board of Commissioners; and any and all
conditions set forth by the Development Review Committee, Planning and Zoning
Board and City Commission.
Section 6. That
any and all previously approved and accepted Plats or portions thereof,
encompassing and applicable to the property described on Exhibit "A",
be and the same are hereby vacated, voided, cancelled and superseded to the
extent that same are in conflict herewith and the Plat accepted and approved
hereby and to the extent that the City of North Lauderdale has the power and
authority to so vacate, cancel, void and supersede these previously approved
and accepted plats.
Section 7. That
all Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in
conflict herewith be and the same are hereby repealed
to the extent of such conflict.
Section 8. That this Ordinance shall take effect immediately upon adoption.
