COMMISSION WORKSHOP – 6 P.M.

 

Workshop convened at 6:17 pm.  

 

1.      North Lauderdale School Facility – Presented by City Manager Richard Sala and City Attorney Sam Goren. 

 

Mr. Sala did a financial picture of the school facility at this time.   He reviewed updated appraisals with or without the gymnasium.  The Consensus of the Commission is that their preference would be to retain the gym for the residents but if that would be a deal breaker then we would have to let it go.    $11,500,000 should be the minimum sale price without the gym.  If the buyer is a school we should make a cross use agreement for use of the gym.  The Commission would like to give the City Attorney, City Manager & staff a few weeks to work with possible buyers and if they do not get results then go to the auction method.

3.      MINUTES – April 10, 2007 – Commissioner Frankel moved to approve as submitted.  Seconded by Commissioner Cangemi.  All yes.

Proposed Fee Schedule Revision (Appendix F) - To Modify BuildingPermit, Land Development and Comprehensive Planning and Zoning Fees

 

Commissioner Frankel moved to read.  Seconded by Commissioner Hilton.  All yes.  Attorney read:

 

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, AMENDING APPENDIX F, "FEES", OF THE CITY OF NORTH LAUDERDALE CODE OF ORDINANCES BY AMENDING ARTICLE I, ENTITLED "COMMUNITY DEVELOPMENT FEE SCHEDULE", AND ARTICLE II, ENTITLED "OTHER FEES AND CHARGES"; TO PROVIDE FOR REVISIONS TO THE FEES SPECIFIED IN THE SPECIFIC SECTIONS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE; PROVIDING FOR AN EFFECTIVE DATE.

 

Community Development Director T. Reed reviewed the proposed amendments to the fee schedule.  Public hearing was opened.  No comments.  Public hearing closed.  Commissioner Frankel moved to adopt.  Seconded by Commissioner Cangemi.

a.       RESOLUTION - Purchase of Aquatic Center Playground – Florida Recreation Development             Assistance Program (FRDAP) Grant

 

A RESOLUTION OF THE CITY OF NORTH LAUDERDALE AUTHORIZING THE EXPENDITURE OF $14,279.43 TO DOMINICA GAME TIME FOR THE PURCHASE AND INSTALLATION OF A PLAYGROUND STRUCTURE AT THE JERRY RESNICK AQUATIC CENTER USING THE   FLORIDA RECREATION DEVELOPMENT ASSISTANCE  PROGRAM; PROVIDING FOR AN EFFECTIVE DATE.

A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, APPROVING A SIGN WAIVER REQUEST FOR LA GRANJA RESTAURANT, LOCATED AT 5480 N. STATE ROAD 7, NORTH LAUDERDALE, FLORIDA, THEREBY PERMITTING THE INSTALLATION AND MAINTENANCE OF TWO WALL SIGNS WITH 24” HIGH CAPITAL LETTERS WHERE MAXIMUM 16 INCHES HIGH LETTERS ARE ALLOWED BY SECTION 94-16 (C) (2) c  OF THE CITY’S CODE OF ORDINANCE WITHIN A COMMUNITY BUSINESS (B-2) ZONING DISTRICT, AND PROVIDING FOR AN EFFECTIVE DATE.

AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA, INTERPRETING ARTICLE III OF THE NORTH LAUDERDALE CHARTER, ENTITLED “LEGISLATIVE FORM OF GOVERNMENT”; SPECIFICALLY CLARIFYING SECTION 3.3, ENTITLED “MAYOR AND VICE MAYOR” TO PROVIDE FOR CONSISTENCY WITH ORDINANCE NO. 06-05-1157; CHANGING THE DATE OF THE ELECTION OF THE VICE MAYOR FROM THE LAST MEETING IN MARCH TO THE LAST MEETING IN NOVEMBER; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE.

 

Commissioner Frankel moved to pass on first reading.  Seconded by Commissioner Hilton.  All yes.

10.  REPORTS

a.      REMINDER – North Lauderdale Days  - Friday & Saturday, April 27th and 28th.  Parks & Recreation Director Sargis gave a run down on the schedule of events.

 

 

11.  COMMISSION COMMENTS

 

a.       REPORT on Tallahassee Legislation (R. Moyle)

 

Mayor Brady thanked City Manager Sala, Vice Mayor Moyle and Commissioner Cangemi for going to Tallahassee and bringing our feelings to the legislators.  He said the trio did a great job.  Vice Mayor Moyle thanked the Commission for the confidence they placed in the 3 that went to Tallahassee.  He said it was hard work, but they saw as many people that they could.  They presented their ideas on the tax reform and how it would hurt the municipalities.  The legislators did not seem to care.

 

b.      WALMART

 

Consensus of Commission:  Have Walmart principals come in at the May 29th meeting and give an update on the progress being made or not being made.

a.      Ratification of Settlements Conducted By FMIT (Campbell and Resnick) Commissioner Hilton moved to approve.  Seconded by Commissioner Frankel.  All yes

Defense of indigents

The City Attorney reported that he met with the Chief Judge of the 17th Judicial Circuit, Judge Dale Ross,  along with Harry Stewart/Ft.Lauderdale; Mark Berman/Dep. City Attorney of Pompano Beach; and Gene Steinfeld/Margate,  along with Broward Public Defender ("PD") , Howard Finklestein on Monday, 4/23 to discuss an exchange of letters with all Broward cities affecting the defense of indigent defendants by the PD for municipal and county  code violations.  Mr. Goren previously advised the City Commission of this issue, which has now matured to a point where the City of Ft.Lauderdale may file a declaratory judgment lawsuit to have a court interpret portions of Article 5 of the Florida Constitution, and Ch. 27, F.S. Mr. Goren also reported that he is inclined to recommend that North Lauderdale join in that lawsuit, if filed, to protect  North Lauderdale's interests, after he has had the opportunity to review the case, at that time.
