Funding for Eligible
Disaster Relief Activities – Hurricane Wilma

In order to be reimbursed by the National Resources Conservation Service (NRCS), a Division of the United States Department of Agriculture, for Hurricane Wilma related expenditures, the Water Control District (District) must submit various agreements and reports. Such funds are being distributed in the form of grants to state, regional, county and municipal entities to assist them in deferring the extraordinary costs associated with damage to waterways resulting from Hurricane Wilma.
The primary consideration of this grant application will allow the District to recover the maximum costs associated with all eligible disaster relief activities that qualify under Federal guidelines.
The City Attorney had already reviewed the necessary agreement and application forms for submittal and has approved them to legal form.
Recommendation:
The City Administration and District Staff recommend the approval of the attached resolution authorizing and directing the proper officers of the City of North Lauderdale and the North Lauderdale Water Control District to take all steps necessary to submit an agreement and all necessary application forms to the National Resources Conservation Service for reimbursement of all eligible disaster relief activities in an amount appropriate to recover the maximum costs allowable.

A RESOLUTION OF THE NORTH LAUDERDALE WATER CONTROL DISTRICT AUTHORIZING
AND DIRECTING THE PROPER OFFICERS OF THE CITY OF NORTH LAUDERDALE AND THE NORTH
LAUDERDALE WATER CONTROL DISTRICT TO TAKE ALL STEPS NECESSARY TO SUBMIT AN AGREEMENT
AND ALL NECESSARY APPLICATION FORMS TO THE NATIONAL RESOURCES CONSERVATION
SERVICE FOR REIMBURSEMENT OF ALL ELIGIBLE DISASTER RELIEF ACTIVITIES IN AN
AMOUNT APPROPRIATE TO RECOVER THE MAXIMUM COSTS ALLOWABLE; PROVIDING FOR
FINDINGS AND CONCLUSIONS WITH REGARD TO THE BENEFITS TO BE DERIVED BY ACCEPTING
SUCH FUNDS; PROVIDING FOR CONFLICTS;
PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE
WHEREAS, the Board
of Supervisors of the North Lauderdale Water Control District is aware of the
need to seek the maximum reimbursement possible for all eligible disaster
relief activities; and
WHEREAS, in
order to assist in achieving this reimbursement funding for the aftermath of
Hurricane Wilma, the Board of Supervisors desires to submit an agreement and
all necessary application forms to the National Resources Conservation Service
for the award of said monies; and
WHEREAS, the Board
of Supervisors recognizes the District’s obligation to provide hurricane
related activities for the public good; and
WHEREAS, the Board
of Supervisors finds that the receipt of the grant funds from the National
Resources Conservation Service will be in the best interest of the health,
safety and welfare of the citizens and residents of the City of
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the City of
Section 1. The
foregoing “Whereas” clauses are hereby ratified and confirmed as being
true and correct and are hereby made a specific part of this Resolution upon
adoption hereof.
Section 2. That the proper officers of the City
of North Lauderdale and the North Lauderdale Water Control District be and the
same are hereby authorized and directed to apply to the National Resources
Conservation Service for the monies reimbursing the District for all eligible
disaster relief activities in an amount not to exceed the maximum allowable
under Federal guidelines.
Section 3. That the Board of Supervisors finds
and determines that it is in the best interest of the citizens and residents of
the City of North Lauderdale, Florida, to accept said funds.
Section 4. The proper officers of City of North
Lauderdale and the North Lauderdale Water Control District be, and each of them
hereby is, authorized and directed to execute and deliver any and all papers,
instruments, opinions, certificates, affidavits and other documents and to do
or cause to be done any and all other acts and things necessary or proper for
carrying out this resolution.
Section
5. All resolutions or parts of resolutions in conflict
herewith are hereby repealed to the extent of such conflict.
Section 6. If
any clause, section, other part or application of this Resolution is held by
any court of competent jurisdiction to be unconstitutional or invalid, in part
or application, it shall not affect the validity of the remaining portions or
applications of this Resolution.
Section 7. That this resolution shall take
effect immediately upon adoption.
