Second Reading and Adoption:

 

Zoning amendment to the City of North Lauderdale Zoning Map to rezone the subject property from Mobile Home (MH) to Parcel A Community Facility (CF), (1.7371 acres) & Parcel B to Community Business (B-2), (2.1142 acres) a total of 3.8513 acres.

The Ordinance before you tonight, for second reading and adoption, proposes to rezone the subject property, a total of 3.8513 acres of land located at Southside of Prospect Rd and East of State Road 7 from Mobile Home (MH) to Parcel A containing 1.7371 acres to be rezoned to Community Facility (CF) and Parcel B containing 2.1142 acres to be rezoned Community Business (B-2).  The specific extent of the anticipated use is explained in Attachment A, and made a part of this report.  The applicant has also provided an economic analysis of the impact of rezoning the property from Mobile Home to Community Facility and Community Business which is attached as Attachment B.

 

The subject property was annexed into the City of North Lauderdale on September 15, 2004. Prior to this annexation, the subject property was a part of unincorporated Broward County, where it was given the zoning category of T-1. After the annexation, the City adopted the zoning category which was most compatible to the County’s T-1 zoning, which is the City’s Mobile Home (MH) zoning and the underlying land use (Commercial) remained the same. Therefore, the underlying future land use of the property (Commercial) is compatible with the rezoning of Parcel B to Community Business. According to the City’s Comprehensive Plan, no more than 20% of the cumulative land area designated for Commercial use on the City’s Future Land Use Map as of July 22, 2003, may be rezoned to non-commercial districts.  The acreage requested by the applicant to be rezoned to Community Facility falls within this limitation.  Staff has reviewed the request for rezoning and taken into consideration the current use of the property and the compatibility of the rezoning with surrounding properties.

 

As the City Commission’s advisory body, the Planning and Zoning Board met on June 16, 2009, and after public hearing and review by the Board and Staff adopted a motion to recommend approval of the proposed rezoning to the City Commission. 

 

The City Commission unanimously approved the first reading of the Ordinance rezoning the property on June 30, 2009. 

 

RECOMMENDATION

 

The City Administration recommends City Commission’s adoption of the attached Ordinance on second reading approving the proposed rezoning. This approval is subject to the following conditions:

 

  1. All terms, conditions and provisions imposed by the City Commission, Planning and Zoning Board and staff shall be met.

 

  1. The rezoning approval is contingent upon the final site plan approval by the City Commission to be submitted at a later date.

 

  1. The rezoning approval is contingent upon the plat approval with proper plat notes that support the development.

 

If the Commission concurs with this recommendation, the following motion is in order:

 

“A motion to approve the second and final reading of the attached ordinance  to amend the City of North Lauderdale Zoning Map to rezone approximately 3.8513 acres of Mobile Home (MH) to Community Facility (CF) 1.7371 acres , and  2.1142 of acres to Community Business (B-2) subject to the conditions listed in staff’s memorandum.”

AN ORDINANCE OF THE CITY OF NORTH LAUDERDALE, FLORIDA, REZONING CERTAIN PROPERTY LOCATED IN THE CITY OF NORTH LAUDERDALE, COUNTY OF BROWARD, STATE OF FLORIDA, TO WIT: TRACT OF LAND IN THE NORTHWEST ONE--QUARTER (NW ¼) OF SECTION 18, TOWNSHIP 49 SOUTH, RANGE 42 EAST AS RECORDED IN BOOK 3128 AT PAGE 352 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA, SAID TRACTS BEING MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO FROM ZONING CLASSIFICATIONS MOBILE HOME (MH) TO COMMUNITY FACILITY (CF, 1.7371 ACRES) AND COMMUNITY BUSINESS (B-2 , 2.1142 ACRES); PROVIDING THAT THE OFFICIAL ZONING MAP OF THE C1TY OF NORTH LAUDERDALE SHALL BE AMENDED TO REFLECT SAID REZONING; PROVIDING FOR CONFLICTS: AND, PROVIDING AN EFFECTIVE DATE.

 

WHEREAS, the City Commission, after public hearing, due consideration, and being fully advised in the premises is desirous of rezoning certain property located in the City of North Lauderdale from zoning classification Mobile Home (MH) to Community Facility (CF) and Community Business (B-2).

 

WHEREAS, the City Commission of the City of North Lauderdale deems said rezoning to be in the best interests of the City of North Lauderdale and the inhabitants thereof

 

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF NORTH LAUDERDALE, FLORIDA:

 

Section 1:        That certain real property located in the City of North Lauderdale, Broward County, Florida, described as:

 

TRACT OF LAND IN THE NORTHWEST ONE--QUARTER (NW ¼) OF SECTION 18, TOWNSHIP 49 SOUTH, RANGE 42 EAST AS RECORDED IN BOOK 3128 AT PAGE 352 OF THE PUBLIC RECORDS OF BROWARD COUNTY, FLORIDA. SAID TRACTS BEING MORE PARTICULARLY DESCRIBED ON EXHIBIT "A" ATTACHED HERETO

 

Be and the same is hereby rezoned from the zoning classification Mobile Home (MH) to Community Facility (CF) and Community Business (B-2).

 

Section 2:        That this rezoning is subject to all terms, conditions and provisions imposed by the City Commission, Planning and Zoning Board, DRC and Staff.


Section 3:        That the Official Zoning Map of the City of North Lauderdale as the same has been officially adopted, and is in effect at the passage hereof, be and the same is amended hereby to the extent of and in accord with the rezoning hereby granted, said amendment to be shown on said Official Map as revised.

 

 

Section 4:        That this ordinance shall take effect immediately upon final adoption.
